By downloading, installing, or using the KeyToUse mobile application and/or any KeyToUse hardware products (including but not limited to WiFi Extension Boxes and Power Switching Boxes), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
1. NO WARRANTY AND DISCLAIMER OF LIABILITY
ALL KEYTOUSE PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
KEYTOUSE AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES RESULTING FROM:
- Your use or inability to use the application or hardware
- Any unauthorized access to or use of our servers and/or any personal information stored therein
- Any interruption or cessation of transmission to or from our services
- Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services
- Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the services
- Any damage to property, personal injury, or loss of life
- Any financial loss, data loss, or business interruption
2. HARDWARE AND SOFTWARE USE
You agree to use KeyToUse hardware and software products only for their intended purposes as described in the official documentation. Any modification, reverse engineering, decompilation, or disassembly of KeyToUse products is strictly prohibited.
YOU EXPRESSLY AGREE THAT:
- You will not modify any hardware or software components
- You will use products only within their specified voltage and amperage limits
- You will ensure proper installation by qualified personnel
- You assume all risks associated with electrical installations
- You will comply with all local electrical codes and regulations
3. INTELLECTUAL PROPERTY RESTRICTIONS
All KeyToUse products, including hardware designs, software code, firmware, documentation, and branding, are proprietary property of KeyToUse. No rights are granted to modify, reproduce, distribute, or create derivative works.
4. RELEASE OF CLAIMS
You hereby release, discharge, and hold harmless KeyToUse, its officers, employees, agents, and successors from any and all claims, demands, causes of action, proceedings, liabilities, damages, costs, or expenses of any kind, whether known or unknown, arising out of or in any way connected with your use of KeyToUse products.
5. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless KeyToUse and its affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from your use of and access to KeyToUse products.
6. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where KeyToUse is registered, without regard to its conflict of law provisions. Any legal action shall be brought exclusively in the courts of that jurisdiction.
7. ACKNOWLEDGEMENT OF RISKS
You acknowledge that electrical devices carry inherent risks including but not limited to fire hazard, electrical shock, property damage, and personal injury. You assume all responsibility for proper installation, maintenance, and use.
